Terms of Service

These terms apply when you create a Dubsend account or use Dubsend.

About these terms

Dubsend is run by ANGVIS LTD ("we", "us"), company 12763866, 61 Bridge Street, Kington HR5 3DJ, United Kingdom. These terms, our Acceptable Use Policy and our Data Processing Agreement form the agreement between you and us. Our Privacy Policy explains how we handle personal data.

Dubsend is for labels, artists, managers and others using it for their music business. By creating an account you confirm that you are at least 18 and use Dubsend for that purpose. If you accept these terms for a company, you confirm you may bind it.

Your account

  • Give a working email address and keep your password safe. You are responsible for what happens in your account.
  • Each account has one login. Don't share it with people outside your business.
  • Tell us at support@dubsend.com if you think someone else has used your account.

The service

Dubsend lets you upload unreleased music, send it by email to your own contacts with a personal link for each person, and see what they did with it. We may improve or change features. If a change takes away something important from a paid plan, we will tell you at least 30 days before.

People who receive your promos don't need an account and don't enter into an agreement with us by using their link.

Plans, prices and payment

  • Plans, prices and limits are on our Pricing page. Prices include VAT where it applies.
  • Payments are processed by Stripe. The reseller and merchant of record is Link, part of Stripe: you buy your plan from Link, which takes the payment, charges any tax, and sends receipts and invoices. Refunds are made by Link under its terms. Link's own terms apply to the purchase.
  • Paid plans renew automatically every month or year until you cancel.
  • An upgrade starts straight away and you pay the difference for the rest of the period. A downgrade, or a move from yearly to monthly, starts at the end of the period you paid for.
  • You can cancel at any time from Manage billing on the Plan page. You keep your plan to the end of the period you paid for, then move to the Free plan.
  • If a payment fails, Stripe tries again for about two weeks. If every try fails, your account moves to the Free plan.
  • Moving to the Free plan never deletes your data. Promos and brands over the Free plan's limits are paused until you upgrade again.
  • If we change prices, we will email you at least 30 days before. The new price applies from your next renewal after that date.

Limits and sending rules

  • Each plan has limits on promos, recipients a month and brands. Dubsend applies them automatically: a send pauses at the monthly limit and tells you what to do.
  • New accounts start with a daily sending limit that grows as their emails are delivered without problems (see the FAQ).
  • Dubsend pauses an account's sending automatically if too many of its emails bounce or are reported as spam, as described in the Acceptable Use Policy.
  • Every promo email includes an unsubscribe link. People who unsubscribe can't be emailed again by that brand. Addresses that hard-bounce or report spam can't be emailed by anyone on Dubsend.

Your music and your contacts

You keep every right in the music, artwork, text and contact lists you upload. You give us permission to store, copy and process them only as needed to run Dubsend for you: for example to make the MP3 streaming copy, add the recipient's name to each downloaded file, resize your cover for emails, and show your promos and reports to the people you send them to.

You confirm that you have the right to send the music and artwork you upload, and that every contact you add has agreed to receive promos from you or is an existing professional contact who would expect them. You must follow the Acceptable Use Policy.

Recipients can download your files. We tag each file with the recipient's name, but we can't stop a recipient from sharing your music and we are not responsible if they do.

Data protection

For the contacts you upload and their activity, you are the controller and we are your processor. Our Data Processing Agreement is part of these terms.

Suspension and closing

  • We may pause sending, or suspend or close an account, if it breaks these terms or the Acceptable Use Policy, puts email delivery for other customers at risk, or if the law requires it. We will tell you why, unless the law stops us.
  • You can close your account at any time by emailing support@dubsend.com from the account's email address. We cancel any paid plan straight away (it doesn't renew) and delete your data within 30 days, as the Privacy Policy explains.
  • We may stop offering Dubsend with at least 30 days' notice. If we do, we will ask Link to refund the unused part of any period you paid for.

Availability

We take reasonable care to keep Dubsend running and your data safe, but we can't promise it will always be available or free of errors. Email delivery also depends on the recipients' email providers: we can't promise that an email reaches the inbox, or that anyone listens.

Liability

  • Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.
  • We are not liable for loss of profits, revenue, business, opportunity or goodwill, or for indirect losses.
  • Our total liability to you in any 12 months is limited to the greater of the amount you paid for Dubsend in those 12 months and £100.
  • If the law treats you as a consumer, nothing in these terms affects your legal rights.

Changes to these terms

We may update these terms. For changes that matter, we will email account holders at least 30 days before they apply. If you don't agree, you can cancel before that date. The date at the top shows the latest version.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. Questions: support@dubsend.com.
